What the law says
House Bill 2102 took effect in Texas on September 1, 2019. Under this law, a contractor cannot pay, waive, absorb or rebate a homeowner's insurance deductible, or advertise that they will.
The law also allows an insurance company to hold back the recoverable depreciation payment until it receives proof that the deductible was paid, such as a canceled check, a credit card statement or a financing agreement.
Why it matters
Your deductible is the part of the loss you are responsible for under your policy. It is applied to every settlement offer, no matter the size of the claim.
When choosing a contractor, look for a permanent place of business, proof of insurance, manufacturer certifications, a written proposal with warranty offerings and local references. A professional contractor should also not ask for money up front.
